Taqlid: Following a School in Islamic Law

THE MAIN Objective of this book is co provide in-depth discussions on those aspects of a Musli1n’s prayer which are subject to differences of opinion in The four madhhabs or “schools of Islamic law,” giving special attention to the Hanafi opinion on each issue. However, since even the concept of taqlid or “following a school in Isla1nic law” is unfan1iliar to many Muslin1s, a discussion on this subject is necessary at the outset.

In this regard, taqlid will be discussed under the following three headings in this chapter: (r) What is 7aqlid; (2) Taqlid: Following an ln1an1 in the Matters of Shari’a; (3) Following One Particular Iman1 in Every Juristic Issue. ‘This will hopefully re1nove any confusion regarding the issue of taqlid, and comfort chose who seek clarifica­tion on the subject.

Definition of Taqlid – FIQH AL-IMAM: KEY PROOFS IN HANAFI FIQH

Literal: Taqlid is the verbal noun derived from the Arabic root q-l-d, which means to place, gird, or adorn with a necklace.

Technical: The acceptance of another’s statement without demanding proof or evidence, on the belief that the statement is being made in accordance with fact and proof.

Tue faculty of taqlid is inherently existent in us. If we had refrained from the taqlid of our parents and teachers, then today we would be deprived of even the basic and preliminary needs of hun1anity. By nature, man is endowed with the ability co in1itate and follow others.

If this was nor the case, we would not have been able to learn our mother tongue. [f we had refused to accept unquestioningly (without de1nanding proof) every command, beck, and call of ou1· teachers, we would have been ignorant of even the alphabet of the languages we speak, lee alone the study and writing of books in those languages. Our whole life-every facet of: eating, drinking, wearing garments, walking, earning, and so forth-is connected with this very concept of taqlid. Our intellectual and cultural development is the result of taqlid of our pa1·ents, teachers, and others.

If the technical terminology of every branch of knowledge were not acquired on the basis of taqlid (i.e. without questioning the authority of that terminology), then pro6ciency in such knowledge could not have been attained. lf the 1neanings of words and their idiomatic usages were not acquired through taqlid of linguists and the norms of our linguistic discourses, we would nor become conversant in any language.

Sometime man learns the harmful effect of poison as well as the remedy effects of medicines by virtue of taqlid. In war, if an army does not accept unquestioningly every order of its commander, victory may not be attained. If the various agencies of govern1nent do not obey the laws pro1nulgaced by me law makers, then law and order cannot be n1aincained in the land. In shore, the progress and perfection of our physical, spiritual, intellectual, academic, 1noral and social life is firmly rooted in taqlid-to accept and obey professional authority.
